Talk to a licensed immigration attorney
Every case is different. Before you file, especially if there's a prior visa denial, overstay, criminal record, previous marriage, or big age or income question, we strongly recommend speaking with a licensed U.S. immigration attorney. Many offer low-cost first consultations.

Each state sets its own driver's license rules, so the first step is always your own state's DMV site. USA.gov keeps a directory of them. Below is the general pattern, and then Ohio as an example because its BMV spells out the rules for non-citizens clearly.
General approach
- Find your state's motor vehicle agency in the USA.gov state DMV directory.
- Look for the page for non-citizens or "legal presence." Most states ask for proof of identity, legal presence, Social Security number (or that one isn't assigned) and state residency, but the exact list is state-specific.
- Many states check immigration status through USCIS SAVE; you can check a SAVE verification case at uscis.gov/save/casecheck.
- Don't assume a Philippine license converts; check what testing your state requires.
Example: Ohio BMV
- Permanent residents who present a valid green card (Form I-551) get a regular Ohio license that expires in 4 or 8 years, depending on choice and qualification. Bring the green card, your Social Security card (if assigned) and proof of Ohio residency. Ohio BMV: Non-U.S. Citizens
- Other non-citizens (for example with an EAD) get a limited-term, non-renewable, non-transferable license that expires with the USCIS document. You present current USCIS documents and proof of Ohio residency each time. Ohio BMV
- Testing is at a driver exam station; the license is issued at a deputy registrar license agency. Ohio BMV
- Effective 6/30/2025, limited-term applicants must meet driver training requirements and bring the BMV5791 Fifty-Hour Affidavit to the driving test. Ohio BMV
- Ohio verifies immigration status through SAVE and can't issue until SAVE verifies. Ohio BMV
- Ohio requires two documents from different sources proving your Ohio street address. Build a personal list with the Ohio acceptable documents tool.
FAQ
- Does a green card holder in Ohio get a regular license?
Yes. The Ohio BMV says a valid Permanent Resident Card gets a regular license expiring in 4 or 8 years. - Where do I find my state's rules?
Start from the USA.gov directory of state motor vehicle agencies, then find that agency's non-citizen page.
